1. La présente est un contrat ayant force obligatoire. Par conséquent, veuillez éclaircir toute question ou préoccupation avant de signer le document. En tant que participant à titre de spectateur, en orientation, comme instructeur, aux activités, aux programmes et aux services de Rowing Canada Aviron (RCA) et ses membres (définis dans les Règlements administratifs de RCA) (collectivement les « Activités »), le soussigné, reconnaît les conditions énoncées ci-dessous et les accepte.

2. Rowing Canada Aviron et ses membres et leurs administrateurs, dirigeants, membres de comités, membres, employés, entraîneurs, bénévoles, officiels, participants, agents, commanditaires, propriétaires et exploitants des installations où les Activités se déroulent et représentants (collectivement l’« Organisation »), ne sont pas responsables des blessures, des blessures personnelles, des dommages, des dommages matériels, des dépenses, des pertes de revenus ou pertes de quelque nature que ce soit que le Participant aurait pu subir pendant les Activités ou résultant de celles-ci, occasionnés de quelque façon que e soit, y compris, mais sans s’y limiter, en raison de la négligence de l’Organisation.
   J’ai lu les paragraphes 1 et 2 et j’accepte d’être lié à ceux-ci.

Description et reconnaissance des risques

3. Je comprends et je reconnais que
   a) les Activités comportent des risques, des dangers et des aléas prévisibles et non prévisibles qu’aucune mesure, précaution ou expertise ne peut éliminer, y compris, mais sans s’y limiter, le potentiel de blessure grave, d’invalidité permanente, de paralysie ou de décès;
   b) l’Organisation peut offrir ou promouvoir des programmes en ligne (comme des webinaires, des conférences à distance, des ateliers ou des formations en ligne) qui présentent divers risques prévisibles et non prévisibles différents des programmes en personne;
   c) l’Organisation a la tâche difficile de veiller à la sécurité et elle n’est pas infaillible. Il est possible que l’Organisation ne connaisse pas mon état de santé physique ou mes capacités, qu’elle évalue mal les conditions météorologiques ou environnementales, qu’elle donne des avertissements ou des directives incomplètes et que l’équipement utilisé fonctionne mal.
   d) Le nouveau coronavirus, la COVID-19, a été déclaré pandémie mondiale par l’Organisation mondiale de la santé (OMS). La COVID-19 est extrêmement contagieuse. L’Organisation a mis en place des mesures préventives pour réduire la propagation de la COVID-19; cependant, l’Organisation ne peut pas garantir que le participant ne sera pas infecté par la COVID-19. De plus, participer aux Activités pourrait accroître le risque de contracter la COVID-19.
4. Je participe volontairement aux Activités. En considération de ma participation, je reconnais par la présente qu’il y a des risques, des dangers et des aléas associés aux Activités ou en lien avec celles-ci. Les risques, les dangers et les aléas comprennent, mais sans s’y limiter :
   a) le fait de contracter la COVID-19 et toute autre maladie contagieuse;
   b) la violation de la vie privée, le piratage, un mauvais fonctionnement des outils technologiques ou des dommages à ceux-ci;
   c) l’exécution de techniques physiques intenses et exigeantes;
   d) de grands efforts physiques, des exercices cardiovasculaires intenses et des mouvements rapides;
   e) la sollicitation et l’étirement de divers groupes musculaires;
   f) l’utilisation non appropriée d’une pièce d’équipement ou une défaillance mécanique d’une pièce d’équipement;
   g) des lésions médullaires pouvant causer une paralysie permanente;
   h) des blessures graves à pratiquement tous les os, articulations, ligaments, muscles, tendons ou autres parties du corps du Participant ou liées à la santé et au bien-être général du Participant;
   i) des égratignures, des entorses, des foulures, des fractures ou des luxations;
   j) une commotion cérébrale ou toute autre blessure à la tête, y compris, mais sans s’y limiter, un traumatisme crânien fermé ou un traumatisme contondant;
   k) l’omission de porter l’équipement de sécurité approprié lorsque requis ou recommandé, comme une veste de flottaison;
   l) la noyade;
   m) la pratique de l’aviron, le maniement de la pagaie, l’aviron de couple;
   n) l’entraînement sur la terre ferme;
   o) l’entrée à l’eau en tombant, plongeant ou sautant;
   p) les périodes prolongées dans l’eau et/ou sous l’eau;
   q) l’éloignement de certains emplacements et l’incapacité d’obtenir une aide médicale urgente;
   r) l’entrée, la sortie ou le fait de tomber d’une embarcation;
   s) les conditions difficiles sur l’eau, le chavirement ou le fait d’être submergé par des vagues;
   t) le contact avec des embarcations, rames, pagaies, quais, objets fixes, équipements, obstacles naturels ou autres participants;
   u) le transport des embarcations pour les mettre à l’eau et les sortir de l’eau;
   v) l’omission d’agir en toute sécurité ou selon ma capacité ou dans les zones désignées;
   w) la négligence d’autres personnes, y compris des spectateurs, des participants ou des employés;
   x) les conditions météorologiques et la température;
   y) des déplacements vers et depuis les sites de compétition et sites d’événements non compétitifs qui font partie intégrante des activités de l’organisation.
   z) la négligence de l’Organisation, y compris l’omission de la part de l’Organisation de prendre les mesures raisonnables pour me protéger des risques, dangers ou aléas associés à ma participation aux Activités.
   J’ai lu les paragraphes 3 et 4 et j’accepte d’être lié à ceux-ci.

5. En considération de l’Organisation qui me permet de participer aux Activités, j’accepte ce qui suit :
   a) lorsque je m’entraîne dans mon propre espace, je suis responsable des environs ainsi que de l’endroit et de l’équipement sélectionné;
   b) que ma condition physique et mentale est appropriée pour participer aux Activités et j’accepte tous les risques liés à ma condition mentale ou physique;
   c) de respecter toutes les règles et tous les règlements de participation aux Activités;
   d) de respecter les règles liées au parcours, aux installations et à l’équipement;
   e) si j’observe un danger ou un risque considérable inhabituel, je cesse de participer aux Activités et je signale immédiatement le risque ou le danger à un représentant de l’Organisation;
   f) les risques associés aux Activités sont accrus lorsque j’ai les facultés affaiblies et j’accepte de ne pas participer aux Activités si j’ai les facultés affaiblies d’une quelconque façon;
   g) je suis entièrement responsable d’évaluer si les Activités sont trop difficiles pour moi. En commençant une Activité, je reconnais et j’accepte la convenance et les conditions de l’Activité;
   h) la COVID-19 est de nature contagieuse et le Participat peut être exposé à la COVID-19 ou être infectée par celle-ci, et une telle exposition peut provoquer des blessures personnelles, la maladie, l’invalidité permanente ou le décès;
   i) je suis responsable de mon choix d’équipement de sécurité et de l’ajustement sécuritaire de l’équipement de sécurité.
   Dégagement de responsabilité et renonciation
6. En considération de l’Organisation qui me permet de participer aux Activités, j’accepte ce qui suit :
   a) l’entière responsabilité de ma sécurité me revient;
   b) j’ASSUME tous les risques découlant de ma participation ou associés ou liés à celle-ci;
   c) que je ne compte pas sur une déclaration orale ou écrite faite par l’Organisation ou ses agents, que ce soit dans une brochure, une publicité ou dans le cadre d’une conversation personnelle, et que j’accepte de participer aux Activités;
   d) je RENONCE à toute revendication que je pourrais avoir aujourd’hui ou éventuellement contre l’Organisation;
   e) j’ACCEPTE librement et j’ASSUME ENTIÈREMENT tous les risques et les possibilités de blessures, de décès, de dommages matériels, de dépenses et de pertes associées, y compris la perte de revenus, découlant de ma participation aux Activités, événements et programmes de l’Organisation;
   f) je DÉGAGE POUR TOUJOURS l’Organisation de toute responsabilité liée à des réclamations, revendications, actions, dommages (y compris les dommages directs, indirects, spéciaux ou de circonstance), pertes, demandes en justice, jugements et frais (y compris les frais juridiques) (collectivement les « Réclamations ») que je pourrais avoir aujourd’hui ou éventuellement, pouvant découler de ma participation aux Activités ou être lié à celle-ci ou découler de celle-ci, peu importe la manière dont elles sont causées, y compris, mais sans s’y limiter, la négligence, la négligence grossière, une opération de sauvetage inadéquate, l’omission, l’imprudence, la violation d’un contrat ou le non-respect d’une obligation légale de diligence de l’Organisation;
   g) je DÉGAGE ET INDEMNISE POUR TOUJOURS l’Organisation de toute poursuite liée à mon exposition ou à mon infection à la COVID-19 causée ou résultant d’un acte, d’une négligence ou d’une omission de moi-même ou d’autrui, y compris, mais sans s’y limiter, l’organisation;
   h) que l’Organisation n’est pas responsable des dommages à mon véhicule, mes biens ou mon équipement qui pourraient résulter des Activités;
   i) la négligence comprend l’omission de l’Organisation de prendre des mesures raisonnables pour me protéger des risques, dangers ou aléas associés aux Activités;
   j) le présent accord de non-responsabilité, de renonciation et d’indemnisation est destiné à être le plus général et inclusif dans la mesure permise par la loi provinciale et si une partie du présent accord est jugée non valide, le reste du document demeure pleinement applicable.

7. Je confirme avoir lu le présent accord et en comprendre le contenu, avoir signé l’accord volontairement et être lié à cet accord comme mes successeurs, mon conjoint ou ma conjointe, mes parents, mes tuteurs, mes plus proches parents, mes exécuteurs, mes administrateurs et mes représentants légaux ou personnels. J’accepte également qu’en signant le présent accord, je renonce au droit d’intenter un procès contre l’Organisation sur la base de toute revendication à laquelle j’ai renoncé par la présente.
   J’ai lu les paragraphes 5 et 7 et j’accepte d’être lié à ceux-ci.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

This is a binding legal agreement. Clarify any questions or concerns before signing. As a participant in the sport of rowing and the spectating, orientation, instruction, activities, competitions, programs, and services of Rowing Canada Aviron and its Members (defined in the Rowing Canada Aviron By-Laws) (collectively the “Activities”), the undersigned acknowledges and agrees to the terms outlined in this document.

Disclaimer 2. Rowing Canada and its Members and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

Description and Acknowledgement of Risks3. I understand and acknowledge that 

a) The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life;

b) The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming;

c) The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and

d) The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that I will not become infected with COVID-19.  Further, participating in the Activities could increase my risk of contracting COVID-19.4.

I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to:

a) Contracting COVID-19 or any other contagious disease;

b) Privacy breaches, hacking, technology malfunction or damage;

c) Executing strenuous and demanding physical techniques;

d) Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements;

e) Exerting and stretching various muscle groups; 

f) The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;

g) Spinal cord injuries which may render me permanently paralyzed;

h) Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of my body or to my general health and well-being;

i) Abrasions, sprains, strains, fractures, or dislocations;

j) Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma;

k) Not wearing appropriate safety or protective equipment, such as a life jacket

l) Drowning;

m) Rowing, paddling and sculling;

n) Dryland training;

o) Entering the water by either falling, diving or jumping;

p) Extended time in the water and/or underwater;

q) Remoteness of certain locations and an inability to obtain emergency medical assistance;

r) Entering, exiting or falling off a rowing boat;

s) Rough water conditions, capsizing, or being swamped by waves;

t) Contact with boats, oars, paddles, docks, stationary objects, equipment, hazards or other participants;

u) Carrying boats in an out of the water;

v) Failure to act safely or within my own ability or designated areas;

w) Negligence of other persons, including other spectators, participants, or employees;

x) Weather and temperature conditions; 

y) Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities; and

z) Negligence on the part of the Organization, including failure by the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with my participation in the Activities.

I have read and agree to be bound by paragraphs 3-4

 Terms 5. In consideration of the Organization allowing me to participate in the Activities, I agree:

a) That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select;

b) That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;

c) To comply with the rules and regulations for participation in the Activities;

d) To comply with the rules of the facility or equipment;

e) That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately;

f) The risks associated with the Activities are increased when I am impaired and I will not to participate if impaired in any way;

g) That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity; 

h) That COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and

i) That I am responsible for my choice of safety or protective equipment and the secure fitting of that equipment.

Release of Liability and Disclaimer 6. In consideration of the Organization allowing me to participate, I agree: 

a) That the sole responsibility for my safety remains with me;

b) To ASSUME all risks arising out of, associated with or related to my participation;

c) That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities;

d) To WAIVE any and all claims that I may have now or in the future against the Organization;

e) To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from my participation in the Activities;

f) To FOREVER RELEASE the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;

g) To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;

h) That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities; i) That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities;

and j) This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of British Columbia and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgement 7. I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.
